Fegmo Privacy, Cookie, and Mobile App Policy

Fegmo Inc. (“Fegmo”, “we”, “us”, or “our”) is committed to protecting your privacy. This Privacy, Cookie, and Mobile App Policy (“Policy”) describes how we collect, use, and protect information when you:
● visit our websites (including fegmo.com and any other sites we operate that link to this Policy),
● use the Fegmo platform and related services (collectively, the “Services”), and
● use our iPhone application (the “App”), including to take photos of products in a store and submit those photos to create or enrich products in the Fegmo platform.
This Policy does not cover the privacy practices of third parties you may access through links or integrations, and it does not modify any separate data processing agreement (DPA) or contractual terms we may have with a business customer. Where a DPA applies, it may govern certain processing activities described below.
If you use the Services through a business customer relationship, your organization controls the Customer Content submitted to the Services. Fegmo processes Customer Content on behalf of the business customer to provide the Services, subject to the applicable customer agreement and any DPA.
1. Information We Collect
We may collect the following categories of information, depending on how you interact with us.
A) Information you provide
● Account and profile information: name, business email, company name, role/title, and related account details.
● Store and organizational context: store location and similar operational details that you or your organization associates with user profiles or accounts (for example, store address, store identifier, or assigned store).
● Support and communications: information you provide through support chats, emails, demo requests, onboarding sessions, surveys, and feedback submissions.
● Content you submit to the Services: product data, spreadsheets, documents, and other inputs that you or your organization upload or enter into the platform.
B) Information collected through the App (including product photos)
When you use the App, we may collect:
● Product photos: images you capture using the App camera to create or enrich products in the platform (“Product Photos”).
The App requires access to your device camera to capture Product Photos. You can manage App permissions in your iOS device settings.
● Image and file metadata: such as file type and size, timestamps, and technical identifiers that may be included in the file (for example, EXIF data). We do not use any geolocation metadata that may be embedded in photos to determine your location, and where feasible we remove or minimize unnecessary metadata during processing.
● Device and App information: device model, operating system version, App version, language settings, time zone, and similar device attributes.
● Diagnostics and performance data: crash logs and performance metrics to maintain App reliability and security.
● Usage activity: actions taken in the App, such as photo capture events, upload success or failure, and feature usage.
No GPS location collection: We do not collect precise GPS location from the App. The store location associated with App activity is derived from the user profile or account context (for example, store assigned to the user, store address captured in the account), not from device GPS.
Important note: Product Photos taken in a real-world environment can unintentionally include personal data (for example, a person’s face, name badge, receipt, or other identifying information). You should avoid capturing unnecessary personal information in Product Photos where feasible.
C) Information collected automatically when you visit our websites or use the Services
● Usage data: IP address, browser type, pages visited, time spent, and referral source.
● Device information: device type, operating system, screen resolution, and similar signals.
● Cookies and similar technologies: described in Section 4.
D) Information from business customers and integrations
If your organization is a Fegmo customer, we may receive information from:
● your employer or organization (for example, your name, work email, role, permissions, store assignment), and/or
● integrations that you or your organization enables, subject to permissions and configurations.
2. How We Use Your Information
We use information we collect for the following purposes:
A) Provide, operate, and improve the Services and App
● Create and manage accounts, authenticate users, and administer access.
● Enable you to capture and upload Product Photos through the App.
● Use Product Photos and related inputs to create product records and associated assets in the Fegmo platform, including extracting product attributes and associating images with products.
● Maintain and improve reliability, performance, and usability of the App and Services.
B) Security, integrity, and compliance
● Monitor for suspicious activity, prevent fraud and abuse, and enforce our terms and policies.
● Comply with applicable laws and respond to lawful requests.
C) Customer support and communications
● Respond to inquiries and provide support.
● Send service-related notices (for example, account alerts and security notices).
● Send marketing communications where permitted by law, with opt-out options.
D) Analytics and product improvement
● Understand usage trends and improve product experience.
● Debug, test, and improve features.
E) AI, knowledge graph, and model improvement
Fegmo uses automation and artificial intelligence to help create, enrich, validate, and organize product data and media in the Services. This may include using Product Photos to identify products, extract attributes, improve image quality, classify products, and generate product content.
Enterprise default and contractual controls. If you use Fegmo through an enterprise or business customer relationship, Fegmo will process Product Photos and other customer-submitted content primarily to provide the Services to that customer. We will not use that customer’s Product Photos to improve models or build cross-customer reference libraries unless the customer has explicitly opted in through a written agreement or an enabled setting under its account.
Enterprise customers may enable or revoke this opt-in setting through their account administrator settings or by contacting privacy@fegmo.com.
Optional contribution for model improvement. If a customer opts in, Fegmo may use certain Product Photos and related data to build and improve Fegmo’s knowledge graph and AI capabilities, including creating reference representations of common products that can improve future performance. Where feasible, Fegmo will take steps to reduce privacy impact, for example by minimizing image background, removing or reducing unnecessary personal information, and using de-identified or aggregated derivatives (such as labels, extracted attributes, or feature representations).
Avoid capturing personal data. Product Photos captured in real-world environments can unintentionally include personal data (for example, faces, name badges, receipts, or other identifying information). Users should avoid capturing unnecessary personal information where feasible.
3. How We Share Your Information
We do not sell your personal information.
A) Service providers and vendors
We may share information with vendors that help us operate the Services and App, such as cloud hosting and storage providers, analytics and performance monitoring providers, customer support tools, security providers, and communications tools. Vendors may access information only as needed to perform services for us, and are required to protect it.
We maintain a list of subprocessors that support delivery of our Services and make it available upon request.
B) With your organization (business customer context)
If you use the Services or App through an organization, your organization may access and administer your account and view or manage content you upload (including Product Photos) according to its permissions and policies.
C) No advertising use in the App. We do not use Product Photos for advertising purposes, and we do not use advertising SDKs for targeted advertising in the App.
D) Legal and safety
We may disclose information if required by law or legal process, or if necessary to protect rights, safety, and security.
E) Business transfers
If we are involved in a merger, acquisition, financing, reorganization, or sale of assets, information may be transferred subject to appropriate confidentiality protections.
4. Cookies, Tracking Technologies, and Mobile SDKs
A) Websites
We use cookies and similar technologies to understand site traffic and usage patterns, improve experience, and measure campaign performance.
Types of cookies used:
● Essential cookies
● Analytics cookies
● Functional cookies
Cookie preferences: You may control cookies via browser settings and, where available, our cookie banner. We do not share personal information for cross-context behavioral advertising on our websites at this time.
B) Mobile App SDKs (Firebase)
The App may use mobile SDKs such as Firebase Crashlytics (crash reporting) and Firebase Analytics (usage analytics) to help us understand stability and usage and improve the App. These tools may collect device identifiers, App event data, crash logs, and performance signals.
We do not use the App for advertising at this time, and we do not use advertising SDKs for targeted advertising in the App.
We do not use data collected through the App to track you across other companies’ apps or websites for advertising purposes.
5. Your Data Rights
Depending on your location, you may have rights under data protection laws, which may include:
● access, correction, deletion, restriction, objection, and portability.
To make a request, contact: privacy@fegmo.com. We may need to verify your identity.
If you use Fegmo through an organization, certain requests may need to be directed to your organization if it controls the data as the customer.
6. Data Security
We use appropriate technical and organizational measures designed to protect personal data. However, no method of transmission or storage is 100% secure.
7. Data Retention
We retain information only as long as necessary to fulfill the purposes described in this Policy, unless a longer retention period is required or permitted by law.
Product Photos captured in the App. The App is designed to upload Product Photos to our backend for processing and product creation. The App does not store Product Photos long-term within the App. Product Photos are stored in secure cloud storage for processing and are generally deleted from the ingestion or processing storage location within approximately 30 days.
Enterprise model improvement election. For enterprise customers that have not opted in to cross-customer model improvement, Product Photos are used to provide the Services to that customer and are not retained for cross-customer reference libraries.
Opt-in model improvement. If a customer opts in, Fegmo may retain limited Product Photos or, more commonly, retain de-identified or minimized derivatives (for example, extracted attributes, labels, or feature representations) for longer periods to improve our knowledge graph and AI capabilities. Where feasible, we will retain derivatives rather than retaining identifiable raw images, and we will apply reasonable safeguards to reduce retention of unnecessary personal information. Deleting Product Photos from ingestion storage does not necessarily remove aggregated or de-identified learnings already incorporated into models, but we will stop using Customer Content for new training or reference library additions after opt-out or revocation.
8. International Transfers
If you access our Services from outside the United States, your information may be processed and stored in the United States or other locations where we or our service providers operate.
8A. California Privacy Rights (CCPA/CPRA)
If you are a California resident, you may have additional rights under the CCPA/CPRA, including rights to access, correct, delete, or limit certain uses of personal information, and to opt out of “sale” or “sharing” as defined by law.
Fegmo does not sell personal information. We also do not share personal information for cross-context behavioral advertising.
To exercise California rights, contact: privacy@fegmo.com. We will verify your request as required by law.
9. Third-Party Services and Links
Our websites, App, or Services may contain links to third-party services or enable integrations. We are not responsible for the privacy practices of those third parties.
10. Children’s Privacy
Our Services and App are intended for professionals and are not directed to children under 13. We do not knowingly collect personal information from children.
11. Changes to This Policy
We may update this Policy periodically. Updates will be posted with a revised effective date. Material changes will be notified through the website, App, or direct communication where appropriate.
